A working draft of a bill to protect access to complimentary and alternative health care practitioners was created for the 2010 legislative session. We have not yet been able to recruit a prime sponsor for our bill. The reason we're working to pass this law is because it prohibits unnecessary government intervention in unregulated health care practices. Most complementary and alternative practices are not dangerous and don't require government regulation. In fact, the Department of Health says a health profession should be regulated by the state only when unregulated practice can clearly harm or endanger the health, safety, or welfare of the public, and the potential for harm is easily recognizable and not remote or dependant upon some tenuous argument. However, practitioners are vulnerable to being charged with practicing medicine without a license. This bill provides a "safe harbor" for people who are practicing healing arts that do no harm, as well as clearly stipulating practices that are prohibited.
